Muslim Marriage in the USA: Finding a Spouse and Making Your Nikah Legal

If you’re a Muslim looking for marriage in the USA, you’ll usually find a spouse through family, your masjid, community events and conventions, or a website. To be sure you’re legally married, follow your state’s process: in most states, that means a marriage license and an officiant the state authorises. An imam can do both at once if your state authorises him.

Is a nikah legally binding in the US?

A nikah is legally binding in the US when it also follows your state’s marriage process. In most states, that means a license first, then a ceremony by an officiant the state authorises, then the license returned so the marriage is recorded.

As of November 2026, each state sets its own rules, so the details depend on where you marry.

Skip the license and you won’t have a marriage certificate, the document you’d normally use to prove you’re married. Texas also recognises informal marriage in limited cases, through a signed declaration or proof that you agreed to marry, lived together in Texas and told others you were married (Texas Family Code §§2.401–2.402). How do you make a nikah legal in the US?

Get the license from your local clerk, hold the nikah with an authorised officiant before the license expires, and make sure it’s returned. Here is how that works in two states:

1. Check your state’s rules on your county or city clerk’s website. Fees and documents vary.
2. Ask your imam whether he can legally solemnise marriages in your state. In New York City, ask whether he is registered with the City Clerk.
3. Apply for the license together, in person where required, and note the waiting period and expiry date.
4. Hold the nikah inside that window. In New York, each of you must state, before the officiant and at least one other witness, that you take the other as your spouse. Where the wali speaks for the bride, ask the imam to include her own words too.
5. Make sure the license goes back to the clerk, then keep your marriage certificate somewhere safe.

If your imam isn’t authorised, marry at the courthouse or with a civil officiant, and hold the nikah the same day.

What does Islam require for a valid nikah?

Under the majority view, a valid nikah needs the bride’s consent, her wali, two witnesses and a clear offer and acceptance. The groom also owes her a mahr.

• Her consent. A woman is not to be married without her permission (Sahih al-Bukhari 5136).
• Her wali. The Prophet ﷺ said there is no marriage without a guardian (Sunan Abi Dawud 2085). The Hanafi school allows an adult woman to contract her own marriage, though it still values the wali’s role.
• Two witnesses and a clear offer and acceptance, usually in front of the imam. New York asks for at least one witness besides the officiant, so the same people can usually serve both.
• The mahr, the groom’s gift to the bride, which is hers by right (An-Nisa 4:4).

Why should the wali insist on the license?

Because the marriage certificate is the wife’s proof that she is married. If the marriage ends or her husband dies, what she can claim as a spouse depends on being able to prove that marriage.

A man who wants the nikah but keeps putting off the license, or wants the marriage kept quiet, is showing you a red flag. A careful wali asks about the license before the nikah date is set. Where do Muslims in the USA find a spouse?

American Muslims find spouses through family and friends, their masjid, conventions and community events, campus networks, and apps or websites.

• Family and friends. The route many families trust most. South Asian families may call it a rishta; Arab families, a khitbah.
• Your masjid. Ask the imam whether the masjid keeps a matrimonial list, holds events, or will help your family make enquiries about a suitor.
• Conventions. Some national conventions add matrimonial events. The ICNA-MAS convention, held in Baltimore in May 2026, listed a matchmaking programme (ICNA-MAS Convention).
• Campus. Muslim Students’ Associations (MSAs) bring young Muslims together at university. Families still need to step in once things get serious.

How can a wali stay involved across distance?

A wali can do his job by phone and video, as long as someone he trusts can meet the man in person.

1. Start with a video call that includes her wali or another family member.
2. If her wali lives overseas, ask a trusted relative, family friend or imam nearby to meet the man and his family.
3. Check identity through people, not just profiles: his family, his imam, his workplace.
4. Meet in public, with a mahram, and let the man do the travelling.
5. Never send money to someone you aren’t married to.

Revert sisters in the US: who is your wali?

If you have no Muslim male relative who can act, your wali is usually an imam or Islamic centre director, arranged through your masjid. This rests on the hadith that the ruler is the wali of whoever has none (Sunan Abi Dawud 2083).

You are far from alone. In Pew Research Center’s 2017 survey, about half of Black American Muslims were converts to Islam, compared with 15% of other American Muslims (Pew Research Center).

1. Speak to the imam where you took your shahada, or at the masjid you attend.
2. Ask whether he can act as your wali, or who can, and how he checks a suitor.
3. Plan the legal side with him: the license and an authorised officiant.

Latina and Hispanic reverts

If you’re a Latina or Hispanic revert, your family may be Catholic or evangelical, and marriage can be when their questions come up.

• Scholars agree that a non-Muslim father can’t be your wali for the nikah, so an imam usually acts. Your father can still be honoured: tell him early, introduce the man to him and invite him.
• If your parents speak Spanish and your imam doesn’t, bring a bilingual friend to family meetings.
